THE FOREST 15% K Dollar Rebate Program
(From 17 June 2022 to 17 July 2022)
1. Applicable Activity
By participating in the activity organized by New World Investments Limited (‘NWIL’) as set out in Clause 2 below (the ‘Activity’), a participant is deemed to have read, understood and agreed to the terms and conditions applicable to the Activity (‘Terms and Conditions’).
2. Details of the Activity
Activity: THE FOREST 15% K Dollar Rebate Program
Activity Period: From 17 June 2022 to 17 July 2022 (both days inclusive)
Venue: THE FOREST
During the Activity Period, participants who are both KLUB 11 Members and K Dollar Program Members and have bound their respective KLUB 11 Membership with their corresponding K Dollar Program account (‘Members’) may, subject to these Terms and Conditions, receive the following rebate reward:
Members who spend K Dollars in one single Eligible Transaction at any Participating Merchant of THE FOREST may receive a rebate of 15% on the amount of K Dollars spent for that same Eligible Transaction (the ‘Reward’).
Redemption Restrictions:
(a) K Dollars spent are not reversible nor refundable.
(b) During the Activity Period, each Member is entitled to receive a maximum of 100 K Dollars from the Reward per day.
3. Special Terms and Conditions applicable to the Activity
3.1. Terms Used
3.1.1. ‘Participating Merchants’ shall mean the merchants at THE FOREST which accept the use of K Dollars as payment or part payment for their transactions. The full list of Participating Merchants can be found at https://theforest.hk .
3.1.2. ‘Rebate of 15%’ shall mean 15% on the amount of K Dollars spent in the corresponding single Eligible Transaction.
Example: A Member who spends 200 K Dollars at one of the Participating Merchants will get a rebate of 30 K Dollars.
3.1.3. ‘Eligible Receipt’ means an original machine-printed receipt issued by any of the Participating Merchants for an Eligible Transaction. NWIL does not accept any photocopied or hand-written receipts and reserves the right not to accept any receipts that NWIL suspects to be invalid, forged or issued not for genuine transactions or on other grounds without any reason.
3.1.4. ‘Eligible Transaction’ shall mean a consumer transaction between a Member and any Participating Merchant at THE FOREST using Electronic Payment but excludes the following:
a) Any cash payment;
b) Any single spending below HK$50;
c) Purchase of any kinds of membership(s);
d) Purchase of pre-paid items, cash vouchers, gift cards or coupons, stored value cards or pre-paid cards;
e) Purchase of show/event/exhibition tickets;
f) Payments using K Dollars and/or THE FOREST physical or electronic gift vouchers;
g) Payments using cash vouchers, gift cards, gift coupons, stored value cards or pre-paid cards of merchants at THE FOREST;
h) Adding value to Octopus cards, stored value cards or pre-paid cards;
i) Currency exchange;
j) Any transactions on K11 ESHOP, Food Ordering via ‘K11 HK’ Mobile App or any online platform of any Participating Merchants of THE FOREST;
k) Any bank transactions;
l) Charity donations;
m) Any bill payment (including but not limited to payment of telecommunication or utility bills);
n) Any other transaction between the Member and any Participating Merchants of THE FOREST as specified by KLUB 11 from time to time (with or without prior notice).
3.1.5. ‘Electronic Payment’ means transaction by credit cards, debit cards, EPS, Android Pay, Apple Pay, PayMe, Samsung Pay, WeChat Pay, Tap & Go, Alipay, Quick Pass and Octopus cards.
3.1.6. Other terms not defined in these Terms and Conditions shall have the same meanings as defined in the KLUB 11 Programme Terms and Conditions.
3.2. Credit of K Dollar Rebates
K Dollar rebate under the Activity will be credited to the Member’s account in the form of K Points with K Dollar rebate of each transaction calculated to the nearest whole number. K Dollar rebate in the form of K Points earned hereunder will be automatically credited to Members’ accounts in three working days after the Eligible Transaction is verified and confirmed by NWIL and shall expire by 30 September 2022.
3.3. Limited Stock
The Reward is offered on a first-come-first-served basis, and shall be available while stock lasts.
3.4. Copying Eligible Receipts
NWIL has the right to make an electronic copy of each Eligible Receipt presented to NWIL in the course of redemption and to keep the electronic copies for audit purpose.
3.5. Marking on Eligible Receipts
NWIL has the right to make any marks on each Eligible Receipt presented to NWIL in the course of redemption. The Eligible Receipt marked by NWIL cannot be used again for participating in the Activity or for redeeming any other gifts or privileges in other promotional activities held by NWIL.
3.6. Verification of Identity
Member shall present his or her KLUB 11 and K Dollar Program e-Membership card and show the linkage of the two memberships for verification at the time of redemption.
3.7. No Exchange
The Rewards cannot be exchanged for cash or other gifts.
3.8. No Liability
NWIL does not warrant that the products and services offered by the individual merchants or redeemed by the participants in the Activity are of any merchantable quality or fit for any purpose. NWIL disclaims all liability in relation to such products and services. The participants in the Activity shall waive all his/her rights and interest, if any, of any nature to pursue against NWIL.
3.9. Termination of the Activity
NWIL has the right to suspend, terminate or cancel the Activity at any time without any prior notice.
4. General Terms and Conditions applicable to the Activity
4.1. Amendment
NWIL has the right to amend any of these Terms and Conditions at any time without any prior notice.
4.2. Interpretation
NWIL has the right to interpret these Terms and Conditions. In case of disputes, the decision of NWIL will be final and binding on all parties concerned.
4.3. English Version Prevails
The Chinese version of these Terms and Conditions are for reference only. In case of discrepancies between the provisions of the English version and the Chinese version, the English version shall prevail.
4.4. Governing Laws
These Terms and Conditions shall be governed by the laws of Hong Kong Special Administrative Region.
